Terms and Conditions:

All stated Terms & Conditions as also Offers & Prices is subject to can be changed without prior Notice. This is not applicable to Items which was ordered before Changes. ONLY and always our Terms & Conditions are valid, otherwise it needs written Form.


Prices and Payments:
The Prices are in Swiss-Francs (CHF) and ONLY this Prices are subject to Billing. All other Currencys are only Clue to our Customers and can slightly vary, dependent on international Exchange Rates. Our Prices are Ex-Fabric and they are Swiss Vat inclusive, as needed for Switzerland Law.

Payments must be done FIRST.

At Prepaid-Orders, which will be not paid after our second reminder email in 5 days, we add from Swiss Customers a expenditure outlay charge of 20.- CHF at order value under 200.- CHF, over this amount the charge is 15% of the value, from EU and other Countrys Customers 60.- CHF per Order under the value of 200.- CHF, over this value the charge is 15% of the order, and we instruct our debt-office to collect the amount.

If there are Back-bookings of Credit-cards, the Diskont-Charges or additional charges have to be paid by the Customer.
The Law about Default of Payment is current Swiss-Law.

Sizing and Colors:

Until today there is no International Sizing-Table. Because that there can be differences to other Shops or other Sizes You know. Technical Specifications or Descriptions are without Obligations. We reserve Changes of Constructions as it will be reasonable Demand.
All Product- and Sizing Descriptions are without Obligations. The same applies to colored Images of the Products; color deviations are possible depending on the settings (graphics card, monitor, monitor settings, brightness and contrast) of your computer system and / or the lighting when taking the Product Images.
Without Obligations are also Update-Errors of our Suppliers, which could offer Items, which are no longer available or if they change (without notice to us) the size- or material descriptions.

 

Shipment:

We normally send Parcels by Postal Service. If needed, we will send larger Packages by an forwarding Agent. If no other Instructions of Customer, it is our Right to Choose which Company and Way to send Parcels. If the sending or shipping of Parcels is blocked by Mistake of Customer we are autorisized to store the Items and to send an Invoice to Customer as it is delivered.
The applicable Law about nonacceptance is current Swiss Law.
All packages are (obligate) insured per package until max. 1000.00 CHF. If there is noticed a damage at delivery, the Customer has to inform the Shipper or the Postal Service immediately. By sending and leaving of the Parcels at us, the Risk of loss or damage is ONLY at the Customer.
We have the Right to send partial-Delivery's. The Customer has to accept and pay partial Deliverys, except those Delivery's are against his Rights or are unreasonable.

"Parcel with collection invitation not picked up": We generally send by registered mail from a value of 300 CHF. This means that you have to be at the address given for delivery. If this is not the case, you will normally have a collection notice from the Post in your mailbox. The Post will keep consignments for collection for a maximum of 10 days, after which they will be returned to us at a cost. These return costs as well as the new shipping costs are at your expense and are not negotiable. A return / cancellation, especially for EU / international shipments, is excluded.

Times of Delivery:

The stated Delivery-times are only applicable, if all needed Informations was stated and the necessary duty was be done by Customer.
All Items which are in Stock, will be sent immediately, or, if there are backorder-items in the order, in maximum 5 working days, if paid, or a bookable Card is stated.
Backorders can need until 12 Weeks (Extreme-Case) because: Backorders of Suppliers, Holiday-times, official Holidays, Custom-made Items.

General maximum Delivery-time: 60 Days. After the maximum Time is without prior Notice an additional Time of 31 Days accepted. Only after this Time we can be setted on Delay.
The Adherence of Delivery-time is the point of sending at us.
If the ordered Items can not be sent in Time without our Mistake, is the observance done by Message to Customer:"ready to send".

If there is Trouble in Case of any Problems without our Mistakes as: War, Embargoes, Accidents, Strike, act of God and other Reasons, or delays with delivery's of pre-Materials or -fabrics, is the Delivery-time setted to an acceptable Limit.
If Delivery is impossible or unacceptable for us through above Problems, we are able to step back of Contract. Same Right for the Customer, if the Acceptance is unreasonable because of Delay.
SR Erotec Schweiz GmbH has the Duty to inform the Customer in Case of this Condition about the Delay.
Other Rights as Compensations are only applicable if Intention or Carelessness of us.

Cancellation if something is not available - no problem, but if you have paid by credit card and tentatively agreed (even tacitly) with the delay, then you will be charged 4% of the card booking fee where we was paying. Prepayment orders by bank transfer will be fully refunded, at cash payments at the post office counter, we keep the postal fee.


If at Shipments to outside of Switzerland appearing delays from the Customs or the Carrier, it is outside of our Control and we can not made be liable for this.

If something once is no longer available, we will refund of course the purchase amount or provide you with a voucher for the amount of purchase. The voucher is valid indefinitely. If you want a payment back to your bank account / credit card used, for the amount of purchase, this is possible within 14 days of the issuance of the voucher or in consultation with you whether a coupon or back payment you would like. Late return refunds on bank account will not be accepted.

Damages of Items and Guarantee:

Basically:
If something is broken or breaks unexpectedly and in unacceptable time - let us know immediately! We also want you to be satisfied!
Products with more than two complaints are kicked out immediately from the assortment!
With your information about it you help us to keep satisfied customers and to win new customers. You also give us the chance to make up for it, although we probably are not really responsible for it.

SR Erotec Schweiz GmbH has the Duty to control all Items prior Shipping for visible defects, without damaging of the Packages.
The customer is liable to control the delivery immediately after receiving.
If immediately Informed (max. 3 days after receipt), and applicable responsibility for defects, we have the Right to send Replacements of our Choice, or we repair the item, without any other responsibilitys for further defects of the Customer.
If the Repair or Replacement is not be done in acceptable Time, or the delivery of repaired or replaced Items fails 3 times, the Customer has the Right to step back of the Contract or get cheaper pricing for this Item.
Further Damages or Costs which are not subject of the Item itself, are not our Problem and Impossible to get of us.
The Customer has to inform us immediately of Damages or Mistakes of the Items, also to let us SEE, where the Problem is by sending it to us.

For electric devices there is a producer warranty and the responsibility is at the Producer.
We do not offer a Guarantee for any of the electric Products which ARE IMPORTED BY US FROM USA, except, it was already delivered defect. These defects have to be reportet to us immediately after receiving the products, at latest 3 days after.
We ourself have at US-Law only an 14-Days to 4-Weeks Gurarantee, so we can not take over the Guarantee which is descripted in the Swiss OR Rule from 1.1.2013.
Our warranty ends at electrical Items from the US at latest 4 Weeks after receiving the goods. After that period, the manufacturer is responsible.
For the Freight Charges we are not responsible.

For EC imported electric Devices is a Warranty / Guarantee at least one Year, mostly two Years from the Manufacturer. Please get informed about the guarantee conditions at the manufacturers website.
Our Warranty ends at latest 6 month after receiving the goods. After that period, the manufacturer is responsible.
For the Freight Charges we are not responsible.

So if there should be something broken, please contact us BEFORE you send anything back. VERY helpful and usually mandatory at visible defects are photos, which we can use to send to our supplier to get a possible & fast replacement.
We will talk to you how we will handle that.
All Damages are excluded as they are normal by wearing, wrong Care of the Products, as also excessive use of them.
For defects of non-expected use of the Items, we have no responsibility. Refunds - if applicable - will only be made by voucher, cash payment is excluded.

Cancellation and Exchange:

You can cancel Your Order at longest 5 Days past Your Order, if Your Order not already was sent or partially sent or if we have already Backordered any Item of your Order or when we have it ready to ship. Backorders are - in sense for a fast delivery - be made right after your oder the same day. So if you want to cancel the order, let us know immediately

For cancelling an Order send us Your Order-Confirmation and Your Cancelling Request. Cancellations, which are sent later as 5 Days will be not accepted. If we have backordered items already when you want to cancel it, it is not anymore possible to cancel the whole order, only that items are valid to cancel, which we have not yet backordered OR which are in our stock.

ALL Sales are definite. Taking back is impossible.
If something is not correct in Sizing, we take it back in the first 5 Days after delivery, only for not-used, not-damaged, unwashed Upper-wear as Skirts, Jackets.
Exceptions of exchange: Onesize-Items, Bi-Size Items (SM-ML, ML-LXL), Stockings & Bodystockings, Hygienic Items, Latex-Items, Furniture and Custom-made Items.
An Exchange because You don't like it is impossible. Please also note that certain color deviations of the Products are possible, depending on the settings of your Device, the Hardware and also depending on the exposure of the Article when the Photo was taken. A return or exchange due to Color deviations will only be accepted if the deviation is significant.

Defective or torn packaging is due to transport (weight on the packaging) and is not a reason for a complaint, return or exchange. We have no influence on how our wholesalers pack the goods and how the carriers handle the imported shipments!


Reasons:
Our shop, or our pricing is not designed for just-returns. That may work at stores with double prizes or sponsored shops & giants like Amazon and consorts. (Whereby at Amazon are some traders who only offer one to ten items at all, overstock, remainders, bankruptcy and old goods, this partly without any profit - unlike us with a range of well over 5500 fire-hot, newest available items + sizes / colors!).
If you pay by card, we have to pay card fees, which we are not allowed to transfer (anymore) to the customer.
Case study:
If you order for 500.- Fr. and then simply return for 300.- Fr. goods, both booking charges are at our expense. But there are not only card fees, there is still our purchase, the freight costs, on import the customs & VAT, warehousing, inventory, the annual tax paid on stock, personnel costs for shipping and returns, chargeback / rebooking costs & more...

We have no need to increase our already too large stock still further and we don't want to wait until someone ordered exactly this article in this size / color and then accept opened packaging / tried-and-tested goods... (Would you?)

Cancellation delayed or ready to ship orders INFO: Just think about it - just one example: YOU work, have a variety of expenses and effords and at the end of the month YOUR boss asks YOU to pay more for your work! If You want to Exchange something, please let us know BEFORE you send it back - write an Email to info-at-fetishladen.ch.
Return-packages without prior Email will not be accepted.
The Exchange-Items are Subject to send back properly packed and with the back-shipping fee of actually 12.80 FR to: SR Erotec Schweiz GmbH, Hubelweg 1, 4936 Kleindietwil, Switzerland at Your Cost. Please add also the Amount for the new Freight of acutally 1- CHF in Switzerland to You.
Please send in the Package the Copy of Delivery-Papers and the Reason of Exchange as also the needed Exchange-Size.
To keep the Deadline of 5 Days, it is OK with the Postal Stamp to send.
Wrong delivered Items we take back OF COURSE, if we be informed also in maximum 5 Days after delivery. Postal Fees will be returned to You.

If you cancel an order, which was paid by creditcard, there are already booked fees by the card companies. The fee is dependent on the total order amount (4% transaction-fee plus our expense fee), and it will be not refunded.

A return and refund of the purchase Price is excluded. We will refund you the purchase Amount by Voucher.
If we accept in a Special Case a Sendback or Cancellation which is normally not Accepted as Sendback or Cancellation, we will hold back from at least 25% up to 45% of the Original Order Value as Restocking- and Cancellation Fee, (included the Creditcard Fee's).
We can make an exception if you pay between 20 - 300% higher prices like in other Swiss shops! Not wished? Well then ... THE BREAD AND THE PENNY don't work!

IMPORTANT:

Please check our Sizing and Your Measures, because an Exchange is expensive for both, You and us. Additional there is more Time to wait for You!

Property of Items:

All delivered Items are our Property until they are completely paid. (especially thought on Backbookings of Creditcards!)
Was or are the Items already in use, is to pay by Customer the normal stated Price & an additional Charge of 100.- CHF for additional Activities.
All Misuse is seen as FRAUD and will be reportet at the Police.

 


Limit of Responsibility:

As not otherwise stated in this Conditions, we are responsible to contracted and not-contracted Duties only when Intention of us. For our co-workers we take the Duty only, when they violate an essential Rule of the Contract.

Products are intended as novelty only, and no representation is made or implied as to their suitability or safety for any particular use. Purchasers use the products entirely at their own risk. The manufacturer or re-seller is not liable for any direct, indirect, incidental or consequential damage or loss howsoever arising caused by use or misuse of the products. This includes, but is not limited to, damage to the products and personal injury or damages due to use or misuse.


Right & Law:

The applicable Law is ONLY Swiss Law, excluded the Law about the International Purchase of movable Items and the Law about conclusion of International Purchases about movable Items.
 

Partial ineffectivity of this stated T&C:

In Case of ineffectivity of one or more of our Terms & Conditions the other Conditions stay fully valid. Ineffectiv Terms & Conditions of the Contract will be replaced by the nearest usable, having legal capacity Rules, which is in the economic Interest of the original Terms.


Cession:

The Customer can not make any Cessions to third Partys, anyway which Reason he may have. We reserve the Right to make Cessions partial or complete to third Partys.

Court of Justice:

Only Court and Place of Justice is Bern, Switzerland. (Bern-Mittelland)
